Make it Delish Recipe Contest (“Contest”)
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING.
THIS CONTEST IS INTENDED FOR LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA WHO ARE 18 YEARS OF AGE OR OLDER AT THE TIME OF ENTRY. DO NOT ENTER IF YOU ARE NOT LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY. VOID OUTSIDE THE UNITED STATES AND WHERE PROHIBITED. SUBJECT TO ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS
1. ELIGIBILITY: Open to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older. The following individuals are not eligible to enter or win a prize: employees, contractors, directors, and officers of Carl Buddig & Company (“Sponsor”), its parent, subsidiary and affiliated companies, and the web design, advertising, fulfillment, legal, judging, administrative, and sweepstakes agencies involved in the administration, development, fulfillment, and execution of this Contest (collectively, “Contest Parties”), and the immediate family members (spouse, parent, child, sibling, grandparent, and spouse or "step" of each) and those living in the same household of each such person (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Contest). Void where prohibited. Culinary professionals may not enter. A Culinary professional means any person who earns their primary income from cooking, catering or creating recipes, or who has earned their primary income from cooking catering or creating recipes within the past 5 years.
2. CONTEST ENTRY PERIOD: Contest begins on October 1, 2015 at 12:00:00 a.m. Central Time (“CT”) and ends on December 31, 2015 at 11:59:59 p.m. CT (the “Overall Contest Entry Period”). The Overall Contest Entry Period consists of three (3) separate entry periods: Period 1: October 1, 2015 at 12:00:00 a.m. CT to October 31, 2015 at 11:59:59 p.m. CT. Period 2: November 1, 2015 at 12:00:00 a.m. CT to November 30, 2015 at 11:59:59 p.m. CT. Period 3: December 1, 2015 at 12:00:00 a.m. CT to December 31, 2015 at 11:59:59 p.m. CT (each an “Entry Period”). The Web Site server is the official clock for this Contest.
3. ASSIGNMENT/OVERVIEW: Create an original recipe that incorporates at least one Buddig or Old Wisconsin product. Each Entry Period will have a different assignment (specified secret ingredient). The assignment for each Entry Period will be specified at time of entry. See Section 5 below for additional requirements for the recipe.
4. TO ENTER: Go online to www.buddigpromos.com (“Web Site”) during the Overall Contest Entry Period and follow the on-screen directions to complete the online entry form and submit your recipe (see below for requirements for recipes) and an optional photo of your finished recipe. There is no limit on the number of contest entries submitted however each recipe you submit must be unique. Recipes cannot be changed, altered, or modified once they have been submitted.
Automated means of entry are prohibited and any use of automated devices will cause disqualification. An email address is required to enter. Only fully completed entries are eligible. In the event of a dispute as to who submitted an entry, the name of the authorized account holder associated with the email address will be deemed to be the entrant and must comply with these Official Rules. The “authorized account holder” is defined as the natural person who is assigned to the email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address. Entrants may not enter with multiple email addresses nor may entrants use any other device or artifice to enter multiple times above the stated limit or as multiple registrants. Any participant who attempts to enter with multiple email addresses or uses any device or artifice to enter multiple times above the stated limit will be disqualified and forfeits any and all prizes won, in Sponsor's sole discretion. Proof of submission is not proof of receipt by Sponsor. By participating, entrants agree to abide by and be bound by these Official Rules and the Sponsor’s decisions.
5. REQUIREMENTS FOR ENTRIES: Recipes that are deemed by the Sponsor, in its sole discretion, to be in violation of these Official Rules or to be otherwise infringing, harmful, inappropriate, defamatory, or generally not in keeping with the image of Sponsor, will be rejected and will not be eligible for the Contest. Entrant acknowledges and agrees that such decisions of Sponsor are final and binding.
Recipes: Recipe must include a complete list of ingredients, exact measurements and complete preparation and cooking instructions, including baking time and temperature (if applicable) and number of servings. Recipes must contain at least one Buddig or Old Wisconsin product and fit into one of the two (2) recipe categories (Appetizers or Entrees). You will need to include a recipe name. Recipes must be written in English. Recipes must be an original creation of the entrant; may not have won previous awards; and may not have been previously published by any third party. Recipes that were previously published by a third party (such as those appearing in cookbooks, drink menus, magazines and newspapers, or publicized on the Internet) and winning recipes from other contests will be disqualified. To be eligible, recipes must be capable of being followed/completed in a standard kitchen, use generally available ingredients and be completely edible. Recipe may not in any other way violate applicable laws and regulations; and may not contain any reference to any third-party trademarks (including for any of the ingredients).
Photos (Optional): Photo must be in JPEG or PNG file format and must be 2 Mb or less. Photos should depict the entrant’s completed Recipe and only the complete Recipe. An entrant may only submit a Photo that he/she has taken. Photos may not include people, may not display any third-party trademarks, names, or third-party logos, and may not depict any copyrighted works owned by third parties.
6. COMMERCIAL USE OF ENTRIES: By entering the Contest or claiming a prize, entrants grant to Sponsor and its affiliates (including their agents and assigns), the irrevocable, royalty-free, worldwide right to publish, reproduce, use, adapt, edit, and/or modify the recipe in any way, in any and all media now known or hereafter discovered, worldwide, including on the Internet and World Wide Web, for advertising, commercial, trade, and promotional purposes, including is a cookbook to be published by Sponsor, without additional limitation or compensation unless prohibited by law, and without notice, review, or approval. This means that recipes may be used by Sponsor for any purpose, including commercial and advertising purposes, in connection with its business and/or the promotion of its products, including in a cookbook that will be distributed to the general public. In addition, winner hereby waives in favor of Sponsor, all rights of “Droit Moral” or “Moral Rights of Authors” or any similar rights or principles of law that winner may now or later have in the recipe. BY SUBMITTING AN ENTRY, THE ENTRANT REPRESENTS AND WARRANTS THAT HE/SHE HAS ALL RIGHT, TITLE, AND INTEREST NECESSARY TO GRANT THE RIGHTS GRANTED HEREIN TO THE RECIPE AND AGREES TO INDEMNIFY AND HOLD SPONSOR HARMLESS FROM ANY CLAIMS TO THE CONTRARY.
7. WINNER SELECTION: There will be two rounds to judging for each Entry Period. Round 1: All recipes will be reviewed by a culinary professional and will be judged based on the following equally weighted judging criteria to determine the top 5 recipes from among all categories to move on to Round 2.

The top 5 recipes for each Entry Period will move on to Round 2. All Round 2 recipes will be prepared and then judged by a qualified panel of judges to determine a First, Second and Third Prize winner for each Entry Period. Recipes will be judged based on the following equally weighted judging criteria:

Flavor: This is still a recipe contest, so the end result has to taste good!
The entrant with the highest total score in Round 2 for each Entry Period will be declared the First Prize Winner. The entrant with the second highest total score in Round 2 for each Entry Period will be declared the Second Prize Winner. The entrant with the third highest total score in Round 2 for each Entry Period will be declared the Third Prize Winner. The First, Second and Third Prize winners will also be deemed Finalists. In the event of a tie, the head judge will select the winner from among the tied entrants based on the flavor of the prepared recipes.
Voting: The nine (9) Finalists’ recipes will be featured on the Web Site for the public to vote for their favorite recipe. Finalists’ recipes will be posted to the Web Site starting on January 15, 2016 at 12:00:00 a.m. CT through January 31, 2016 at 11:59:59 p.m. CT. Voters will need to register to vote. Limit one (1) vote per person. Voters may not vote with multiple accounts or e-mail addresses nor may entrants use any other device or artifice to vote multiple times. The use of automated voting methods, voting by proxy or any inducement for votes is strictly prohibited and suspect votes will be disqualified, and Sponsor reserves the right to disqualify Entrants associated with suspect votes in Sponsor’s sole discretion. Votes received from IP addresses outside the United States will be disqualified. The Finalist whose recipe receives the most votes will be declared the Grand Prize Winner. In the event of a tie, the winner will be the Entrant with the highest score from Round 2.
8. PRIZES:
ONE (1) GRAND PRIZE: $10,000, awarded in the form of a check.
THREE (3) FIRST PRIZE PRIZES (ONE PER ENTRY PERIOD): $1,000 awarded in the form of a check.
THREE (3) SECOND PRIZE PRIZES (ONE PER ENTRY PERIOD): $500 awarded in the form of a check.
THREE (3) THIRD PRIZE PRIZES (ONE PER ENTRY PERIOD): $250 awarded in the form of a check.
Total Value of all Prizes in this Promotion: $15,250.
9. PRIZE RESTRICTIONS: Prizes are non-transferable. Winners are solely responsible for any taxes on the prize, and the Grand and First Prize winners will be issued an IRS Form 1099 reporting the value of prizes won.
10. FINALIST NOTIFICATION AND PRIZE CLAIM: Potential Finalists are subject to verification, including verification of age. Potential winners will be contacted via a traceable method of delivery sent to the address provided during registration and will be required to complete, sign, and return an Affidavit of Eligibility/Liability Release/Publicity Release (granting the use of the Winner’s name, city/state, likeness, or photograph by Sponsor for advertising/publicity purposes, without further compensation), except where prohibited by law, and an Assignment of Rights to the winner’s recipe, within five (5) days of attempted mail notification or prize may be forfeited and an alternate winner may be contacted. If winner is not the age of majority in his or her state of residence, prize will be awarded to the parent or legal guardian. In the event of non-compliance with these Official Rules, or if a prize notification or prize is unclaimed or returned as undeliverable, the prize will be forfeited and an alternate winner may be contacted. Sponsor is not responsible for any change of mailing address, email address and/or telephone number of entrants. In the event of non-compliance with these Official Rules, or if a prize notification or prize is unclaimed or returned as undeliverable, the prize will be forfeited and an alternate winner may be contacted. Finalist Prizes will be shipped to the addresses used during registration/provided during notification within 4-6 weeks after the end of the Overall Contest Period.
11. GENERAL CONDITIONS: INTERNET CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE/APPLICATION OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW INCLUDING CRIMINAL PROSECUTION. If the Contest is not capable of running as planned for any reason, including without limitation, due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, Sponsor reserves the right, at its sole discretion, to disqualify any individual who is responsible or who tampers with the entry process, and to cancel, modify, or terminate the Contest. In the event of cancellation, Sponsor will award the prizes in a random drawing from among all eligible, non-suspect entries received prior to cancellation. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. In the event that an entry is confirmed to have been erroneously deleted, lost or destroyed, entrant’s sole remedy shall be another entry into the Contest. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced. No more than the advertised number of prizes will be awarded. As a condition of entering, entrants agree (and agree to confirm in writing): (a) to release Sponsor and Contest Parties from any and all liability, loss, or damage incurred with respect to entrant’s participation in the Sweepstakes and the awarding, receipt, possession, and/or use or misuse of any prize; (b) under no circumstances will entrant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Contest or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. Entrants agree to be bound by these Official Rules and the decisions of the Sponsor and/or its designated administrator. Information collected in connection with this Promotion is subject to Sponsor’s Privacy Policy (available at www.buddig.com/privacy.aspx. Entrants and winners, in accepting a prize, agree to release, indemnify and hold harmless the Sponsor and the Contest Parties from any and all claims of liability related to participation in the Sweepstakes and use or acceptance of prize. Further, no responsibilities are accepted for any additional expenses, omissions, delays, rerouting or acts of any government or authority. This Contest is offered only in the United States and is governed by the laws of the state of Illinois, and entrants consent to jurisdiction and venue in, and agree that all claims and disputes must be resolved exclusively in the federal or state courts in Cook County, Illinois.
12. LIMITATIONS OF LIABILITY AND RELEASE: No liability or responsibility is assumed by Sponsor or Contest Parties resulting from user's participation in, attempt to participate in, or download of any information in connection with participating in, the Contest. No responsibility or liability is assumed by the Sponsor or Contest Parties for technical problems or technical malfunction, including, without limitation, those arising in connection with any of the following occurrences that may affect the operation of the Contest: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless, or Internet connectivity, or other online communication problems; errors or limitations of any Internet service providers, servers, hosts, or providers; garbled, jumbled, or faulty data transmissions; failure of any email transmissions to be sent to or received; lost, late, delayed, or intercepted email transmissions; inaccessibility of the Web Site in whole or in part for any reason; traffic congestion on the Internet; unauthorized human or non-human intervention in the operation of the Contest, including without limitation, unauthorized tampering, hacking, theft, virus, bug, worm; or destruction of any aspect of the Contest. Sponsor is not responsible for any typographical errors in the announcement of the prize or these Official Rules, or any inaccurate or incorrect data contained on the Web Site. Use of Web Site is at user’s own risk. Sponsor and the Contest Parties are not responsible for any personal injury or property damage or any other losses of any kind that may be sustained to user's or any other person's computer equipment resulting from participation in the Contest, use of the Web Site or the download of any information from the Web Site, or any other loss related to user’s participation in the Contest or receipt of any prize. As a condition of entering, entrants agree (and agree to confirm in writing): (a) to release Sponsor and Contest Parties from any and all liability, loss, or damage incurred with respect to entrant’s participation in the Contest and the awarding, receipt, possession, and/or use or misuse of any prize, including any traveling related thereto; (b) under no circumstances will entrant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs.
13. PUBLICITY: Except in Tennessee, and where prohibited by law, by accepting a prize, winners (or winners’ parent/legal guardian, if winner is a minor) grant permission for Sponsor and those acting under its authority to use their name, and address (city and state), photograph, voice and/or likeness, for advertising and/or publicity purposes, in any and all media (including posting on the Web Site) now known or hereinafter invented without territorial or time limitations and without further notice to and without additional compensation. If you are selected as a winner, your information may also be included in a publicly-available winner’s list.
14. WINNSERS LIST: Winners will be posted on www.buddigpromos.com approximately 30 days following the conclusion of the Promotion.
